Claims arising out of the Government’s continued enforcement of the 2004 Guidelines for Research and Development Expenditures, which allegedly resulted in expenditures incurred by the claimant in 2012-2015. A previous tribunal, Mobil Investments and Murphy Oil v. Canada, found the Guidelines to violate NAFTA and awarded the claimants a portion of the damages sought.
