Indirect controlling shareholding in two companies, Hibernia Management and Development Co. and Terra Nova Oil Development Project, engaged in two petroleum development projects off the coast of the Province of Newfoundland and Labrador in Canada.
Claims arising out of the Government’s continued enforcement of the 2004 Guidelines for Research and Development Expenditures, which allegedly resulted in expenditures incurred by the claimant in 2012-2015. A previous tribunal, Mobil and Murphy v. Canada, found the Guidelines to violate NAFTA and awarded the claimants a portion of the damages sought.
