Mining rights held under a concession contract, comprising the Angostura gold and silver deposit in the Santurbán region of northeastern Colombia.
Claims arising out of the National Mining Agency’s decision (2016) that deprived the claimant of its mining rights in respect of 50% of the concession area (a gold and silver deposit) held by it since the mid-1990s. The relevant area was found to fall within the Santurbán Páramo, an environmental conservation zone. The Mining Agency’s actions followed the decision of Colombia’s Constitutional Court that broadened restrictions on mining in high-mountain ecosystems known as páramos (sources of the country’s freshwater supply), striking down legal provisions that had stabilized the rights of mining projects in those areas negotiated before 2010.
